1

Agreement of purchase and sale review

Before you sign or immediately after, we can review your APS for conditions, deposit terms, inclusions, and any clauses that could expose you to risk — including the implications of waiving the financing or inspection condition, which is common in Hamilton’s competitive market.

2

Title search and title insurance

We conduct a full title search of the Hamilton property through the Ontario Land Registry, checking for liens, encumbrances, easements, and other potential issues. We then arrange title insurance through a reputable underwriter to protect your ownership interest.

3

Mortgage instructions and lender coordination

We receive and review mortgage instructions from your lender, ensure all conditions are met, and coordinate the flow of funds on closing day. Whether you are using a major bank, credit union, or private lender, we manage the process end to end.

4

Statement of adjustments and closing funds

We prepare the final accounting of property taxes, utility adjustments, and all other closing costs so you know exactly how much certified funds to bring on closing day. No surprises.

5

Title registration and key release

On closing day, we register the transfer of title electronically with the Land Registry Office. Once registration is confirmed and funds are exchanged, we authorize key release. You receive a reporting letter with all registered documents for your records.

Honest pricing, no surprises.
Our flat fee includes the office disbursements most firms charge extra for. No conveyancing fees and no file management charges added on closing day. Large transaction? We are one of the few Ontario residential real estate law firms insured up to $10 million in errors & omissions coverage.

Still comparing? If you have a written quote lower than our fee, we will match it. No surprise conveyancing fees, no file management charges, and no hidden costs on closing day. Read our full fee schedule

Hamilton Home Buyer Considerations

Hamilton’s real estate market has its own dynamics that affect your purchase legally and financially. As a firm rooted in Hamilton, we know these factors well.

No municipal land transfer tax

Unlike Toronto, Hamilton buyers pay only the Ontario provincial LTT. On a $700,000 purchase this saves you approximately $10,000+ compared to buying in the city.

First-time buyer rebates

Ontario first-time home buyers may claim a land transfer tax rebate of up to $4,000. We confirm your eligibility and apply the rebate automatically during closing.

Older housing title issues

Some Hamilton properties have unique title situations due to the way Hamilton grew over the years. We are familiar with these local title matters and will assist with these during closing.

Condo purchases in Hamilton

Buying a Hamilton condo requires review of status certificates. We can review the condo corporation’s status certificate to satisfy your inquiries or your lender’s inquiries.

Frequently Asked Questions — Buying a Home in Hamilton

Do I need a home purchase lawyer in Hamilton, Ontario?

Yes. In Ontario, a home buying lawyer is legally required to complete the transfer of title and register the deed. Unlike some provinces, Ontario does not allow notaries to close real estate transactions. Your home purchase lawyer handles the title search, reviews the purchase agreement, coordinates mortgage instructions from your lender, and registers the transfer on closing day.

Li Cheng Law flat legal fees start at $1,449 plus HST for a standard residential purchase in Hamilton.  You receive a complete written quote before signing anything — no surprises on closing day. Other closing costs, in addition to the flat legal fee, include land transfer tax, title search costs, title insurance, land registry office fees, tax certificate, and status certificate fee.

Hamilton buyers pay only the Ontario provincial land transfer tax, not a municipal land transfer tax. On a $700,000 home, Ontario LTT is approximately $10,000+. First-time home buyers in Ontario may qualify for a rebate of up to $4,000. We calculate your exact LTT and any applicable rebates as part of the closing process.

The standard legal closing process typically takes 2 weeks once your lawyer receives all of the required onboarding information from you.

Closing timing is affected by other parties involved, such as your lender, your insurance company, the seller’s lawyer, and other parties involved on the seller’s side.

You will usually sign closing documents within a week before the closing date. Keys are released once the title transfer is registered with the Land Registry Office, typically mid-late afternoon on the closing day.

Many of our clients prefer our remote signing options. However, if you would like in person signing, our office is located at 10 George Street, Unit 200, Hamilton, Ontario.
